E-Verify Federal Contractor Rule Delayed 4th Time

Seyfarth Shaw reports:

“The federal government has extended, for a fourth time, the effective date of the E-Verify requirement for federal government contractors. The regulation is now set to take effect on September 8, 2009. The effective date is being delayed to give the Obama administration additional time to review the regulation, which was originally scheduled to be implemented on January 15, 2009. According to the U.S. Chamber of Commerce, an official announcement of the delay is expected to be published in the Federal Register this week.”

E-Verify Facts:

– Use of E-Verify is mandatory in 12 states
– 6.6 Million E-Verify queries were run in 2008*
– Over 1000 companies sign up each week*
– More than 100,000 employers use E-Verify today*
– 96% of workers immediately are authorized to work through E-Verify*
– Employees have the right to contest results
– 13% of all new hires were E-Verified in 2008

A Growing Trend – Data Security and Protection

identity_theftRecognizing the dangers of identity theft in the workplace, New York has joined 28 other states that have enacted laws intended to protect employees from identity theft.

TAKING IT A STEP FURTHER

Earlier this year, a new law went into effect in New York limiting employers’ use of employees’ personal information.

New York Labor Law § 203-d prohibits employers from communicating an employee’s social security number, address, telephone number, personal e-mail address, internet user identification name or password, parent’s surname or driver’s license numbers to the general public. The law also prohibits employers from publicly displaying an employee’s SSN, printing SSNs on identification badges or time cards, or using SSNs to identify employees for licensing purposes.

4 STEPS EMPLOYERS SHOULD TAKE

  1. Review your company’s use of full or partial SSNs and all other personal identifying information and make sure you are compliant with your state law.
  2. Draft privacy policies focusing on the use of personal information and specify which individuals should have access to this information.
  3. Communicate this privacy policy to all employees,with special focus on human resources, loss prevention, recruiting, benefits,and information technology personnel who may have access to identifying information.
  4. Ask your employee screening provider how they protect employee’s personal information.

E-Verify for Federal Contractors Delayed Again

April 17, 2009 By Chris Miller

The effective date of the rule requiring federal contractors and subcontractors to begin using the E-Verify system has been pushed back by six weeks to June 30, 2009.

The extension provides the Obama Administration an adequate opportunity to review the entire rule prior to its applicability to federal contractors and subcontractors.
